ITAR
International Traffic & Arms Regulations
The U.S. Government regulates the exportation of equipment, software, and technology deemed sensitive for national security or foreign policy reasons. Many of the items and equipment covered by these regulations are so-called “dual use” items that have both military and civilian uses. There are three different Federal agencies involved in the export control regime: The Departments of State, Commerce, and the Treasury.
The most significant source of export rules is the Arms Export Control Act (AECA), which is implemented by the Department of State through the International Traffic in Arms Regulations (ITAR). The ITAR covers military articles and technologies, but also covers many dual use items.
ITAR compliance is required by the U.S. Government for all manufacturers, exporters, and brokers of defense or defense-related articles, defense services or related technical data. For a company to become ITAR compliant, they must register with the State Department’s Directorate of Defense Trade Controls (DDTC) along with fully understanding and abiding by the ITAR for all applicable United States Munitions List (USML) goods or services.
Complying with ITAR is a difficult task with stringent requirements on managing agreements, licenses, and other obligations, including record keeping, document version control, visitor management, and information security. The failure to comply with these ITAR requirements can result in fines, denial of further exporting privileges, and jail terms for the violator, company executive and board members.

Why is a defense and security contractor involved in cocoa, aluminum ingot, coffee, and ferroalloys? Governments always seem to have hard currency for weapons systems, people think, and sometimes at a tradeoff for basic services. Maybe there is a better way?
The main role of a government is to provide basic services, but too often basic services seem to include only ‘security,’ with education, sanitation, jobs, and medical falling far behind.
We think there is a better way to accomplish all these goals.
Yes, countries need hard currency with which to purchase the defense and security items and services needed to protect their citizens, and since this currency is often earned through the exports of soft commodities such as cocoa and coffee, or metals such as aluminum ingot and ferroalloys, we made a conscious choice to become involved in the responsible marketing and sales of these items.
How do we differ from those colonial European traders who bought cocoa and coffee from back in the 1880’s?
We take a far longer view, and look at all the stakeholders involved. Our cocoa and coffee suppliers are UTZ certified, our metals suppliers are ISO-9000 registered… safety for the workers is of paramount importance, as is sustainability, women’s employment and advancement, and respecting child labor laws. A living wage, with the ability to live better than the ancestors, is how all parties prosper.
